In the mean time, Dr. Mahtani and his lawyers have submitted numerous evidences and testimonials to prove his legal ownership over the factory. Some of his strongest evidences are signed shareholder’s agreement, financial exhibits and accounts which confirm his investments of more than USD 12 million as well as audit report from an independent auditor which proves that the factory was established as a joint venture establishment and Dr. Mahtani was the sole joint venture owner with all other members as shareholders. Despite these evidences, Dr. Mahtani has been fighting the case for more than ten years without any results.
While the judge handling the case made some progress few months back, it was all in vain when the final judgment was announced. As per the final verdict, Dr. Mahtani claims of being the legal owner of the factory were blatantly rejected. This is in sharp contrast with the announcement made few months back according to which the case hearing was closed and final judgment was to be given after analysing the evidences from both ends.
Considering the final judgment to be foul play, Dr. Mahtani has now appealed to the higher court of Zambia
